1. Reporting Infringement – Takedown Notice

To submit a valid DMCA takedown notice, you must provide the following information in writing to our Copyright Agent. Incomplete notices may not be processed.

Your notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, provide a representative list.
  • Identification of the material that is claimed to be infringing (or the subject of infringing activity) and that is to be removed or disabled. Include information reasonably sufficient to locate the material on our website (e.g., the full URL of the page).
  • Your contact information – name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Do not send general inquiries or scholarship-related questions to this address – they will not be answered. Use our Contact Us page for non-copyright matters.

We aim to respond to all valid DMCA notices within 5–7 business days.


3. Counter-Notification Procedure

If you believe that material you posted on UP-Scholarship.org was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must be in writing and include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district (or the judicial district where your address is located), and that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed material.


4. Repeat Infringers

In accordance with the DMCA and other applicable laws, UP-Scholarship.org maintains a policy of terminating, in appropriate circumstances, the accounts (or blocking access) of users who are determined to be repeat infringers. Since our website primarily does not host user accounts, this policy applies to any repeat offenders who persistently upload or request inclusion of infringing content through our contact forms or comment sections.

We also reserve the right to remove any content that is alleged to be infringing without prior notice, at our sole discretion.


5. Disclaimer Regarding Third-Party Content

UP-Scholarship.org is an educational blog that sometimes references, quotes, or links to third-party content (including official government documents, news articles, or public domain materials). Such use is typically intended as fair use for commentary, criticism, or educational purposes under Indian copyright law (Section 52 of the Copyright Act, 1957) and U.S. fair use doctrine. However, if you believe a specific instance exceeds fair use, please notify us using the process above.

We do not host, upload, or distribute unauthorized copies of copyrighted books, journals, software, or media.


6. Misrepresentations

Any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake, may be liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA. Please act in good faith.
